How to Check My Background & Criminal History Records 02/07/2012

Consumer and criminal history records can be either a blessing or a curse. A clean credit history and blemish-free criminal history allows you to obtain low interest rates on loans and qualify for good jobs. A poor consumer and criminal background severely restricts your resources and ability to advance at work. Checking your background and criminal history records often is important so you know how to properly fill out paperwork and answer tough questions during interviews.

1.  Request a copy of your credit history from each of the three major credit bureaus. Experian, Equifax and Trans Union all keep separate records and will tell you what is on your consumer report. You are allowed to request one free copy from each agency one time per calendar year.

2. Conduct a background check through an online records company. Companies such as U.S. Search gather records from both consumer and criminal agencies and compile them by name, and list things such as loans, home ownership, and criminal offenses. You will fill out an online form and pay for the records with a credit or debit card over the Internet.

3. Visit your local state patrol office and speak to a records clerk for directions on filling out a state criminal history check. A state examination of your records will locate any contact yours had with patrol officers at any location in the state.

4. Run a background check on yourself through your city police and county sheriff’s office. Each agency maintains different records and will be able to tell you what violations you have incurred through their particular department. A waiting period of up to 72 hours is normal for a background check, so ask the clerk when you can expect to pick up your results.

5. Get copies of dispositions from your local courthouse. While police offices and sheriffs’ departments keep record of violations, they are not mandated to keep track of what happens when cases go to court. The court records office will be able to tell you what you pleaded and what corresponding sentence was imposed.

VIDEO TRANSCRIPT
Hi. My name is Justyn, with Justyn Paul Management. I’m going to be talking to you about how to conduct a criminal background check. This is a very important tool. Especially if your industry that you're in requires that you have done some kind of criminal background or a due diligence, to make sure that your employees or contractors, that may be handling sensitive information such as social security numbers or credit card information. You need to be able to run a criminal background check, to make sure those employees do not have a criminal record. Especially if, for example, they are dealing with financial information and they don't have theft or fraud record. So, it's just an important tool to have in your tool belt. First thing you're going to do is, you're going to collect the information from the applicant. The information that you're going to need is first, middle, last name, date of birth, social security number. You may even need to collect information of the last few years of address's, aliases, and things like that. Next thing that you're going to do is you're going to get consent from them. This can be a very simple form that simply states that, we may be running your information for criminal background check. Do you consent to this? Then at least you have some way to show that they were aware of the fact that you were going to be running a criminal background check. Some states actually require, if you're going to be submitting forms to them, that a consent form has been signed. So, check with your state, to make sure that is the case. Next thing that you're going to do is, you can go, actually directly to the F.B.I., the Federal Bureau of Investigation. Just do a quick goggle search for FBI, background check. You'll see a form there. It costs, as of this video, $18.00 for an individual. And what they'll do is, they in fact often need fingerprints too. So, I don't think it's a requirement, but it may be, so you need to double check that. But what they'll do is they'll actually run a cross cert data base, to see if there are any information. If they cannot find anything, they'll just send a simple response back that says, no record. So, that's a good thing, it means the applicant hasn't had any crimes with their name or social is associated with. Another place that you can go, that I've used actually, is the mini states, actually have a data base of crimes and names associated with those crimes, that they make freely available. But if you really, really wanting to grill down and make sure you've got everything that you can possibly find and prove that you have done you're due diligence, you can hire a third party investigator. There are many wonderful online places you can go with services ranging from thirty to hundreds of dollars, for a background check. And those can be very thorough or they can be very basic. But that's the best way to go through the process. Again you've got to collect the information. Get their consent. You can go to the Federal level, which is the F.B.I., to get the background check. Go to the state level, to see if there are any records. You can always go to a third party as well.

How to Find a Criminal Record - WIKIHOW 12/16/2011
4 Comments

Here are five simples steps to successfully searching for Criminal Records.
STEPS
1.  Know what type of criminal record you are searching for to allow for a more efficient investigation. (Incarceration, Civil, Arrest, Wants and Warrants, Police, Criminal, Felony, Misdemeanor, Bankruptcy)

2.  Find out where the person you are searching for has lived in the past 10years. Many criminal record search databases only have records for certain states. If the person in question has moved states recently, his/her criminal record might not show up in records for the current state they are living in.

3.  Search your state’s government sites online to see if they have a page dedicated to criminal records. Some states offer criminal record information for free while others require a fee for running a search.

4.  If you need more information than what is at state level, search criminal records online by county as well.

5.  Often times a name will bring up several results. You can narrow down the search by inserting their name, sex, birth date, status (released or still in custody), where they were incarcerated, and/or their race.

Warnings  >

  • There are laws about how criminal records can be used. It is illegal to use them to bother, stalk, harass, threaten or embarrass someone.
  • If you wish to run a criminal background check for an employee screening, you must do so through a FCRA compliant provider.
  • To find out more information on what you should be aware before you search for criminal records visit http://www.criminalcheckreviews.com/mistakes.html (bad link)

A criminal background check is something you must have heard of, given the high incidence of crimes in the present day. But do you know that it is not just business giants or security establishments which require carrying out criminal background checks for their staff and probably you or your business too could be hit if you decide to take a chance with it? Unfortunately, awareness on the need for such security measures lacks and it is for that very reason that I have compiled for you this quick guide on what criminal background checks actually pertain to and why they must not be disregarded by you:

What Actually Is A Criminal Background Check?

This seemingly loaded phrase actually entails simpler meanings and basics. Criminal background checks simply mean figuring out or ascertaining any individual’s character and social standing through examining his past actions and activities. So any new entrant into your social (or even personal, for that matter) sphere must ideally be subjected through this screening to ensure your safety.

The Need For A Criminal Background Check

I am sure that you must have come across people propagating the need for criminal background checks pretty often. The “Patriot Act”, which was enacted as a response to the September 11, 1991 terror attacks clearly calls for proper identification and screening of prospective tenants. Apart from that, there could be a zillion associations that could ask for proper criminal background checks before being made. So it could be for keeping a track on shady neighbors, cheating spouses, prospective employees, deadbeat parents, or even prank callers. The rationale is that it is better to be safe than sorry.

Get the Criminal history of anyone easily with a Criminal Background Check

How It Is Done And The Costs Involved….

The entire process of carrying out criminal background checks has been revolutionized today. So one does not have to go government office-hunting in remote regions (tiresome and involves lots of traveling costs) and neither is hiring an expensive personal investigator (the fee could sometimes run into thousands of dollars) the only alternatives to find correct information about a person. The world of web has simplified the entire thing with the provision of FREE criminal background checks. Also, one can delve a bit deeper for extremely detailed information like the ones pertaining to specific dates and places, arrests, convictions, length of time spent in prison, parole information and current living and working status of the subject through instant criminal background check services provided by the various websites. They work by aligning with the national criminal background check database and one can expect to get detailed relevant information for as low a $40 a year through these. The features like privacy and protection of both the parties too is amply taken care of by these and the information can also be trusted to be reliable.

I am sure that with such slashed rates and evident imperativeness of carrying out background criminal checks, you would not risk your own as well as your family or business’ stakes any more.

A criminal background search is the process of finding the criminal history of an individual. Criminal background checks are routinely performed before employment is offered, with an offer of employment being conditional upon a clear criminal record. A person's arrest history, incarceration records, and instances of sexual offenses can be found through the performance of criminal background searches.

If a criminal offense is found on your record, the following things will be taken into consideration: how old you were when you committed the offense; the type and severity of the offense (misdemeanor, felony, etc.); how much time has passed since the offense occurred; whether you are currently on probation; if the offense was related to employment; and if there is a long history of committing offenses.

The presence of a criminal offense on a person's criminal record does not necessarily preclude employment. However, certain offenses will prevent employment for particular lines of work. Those with sexual offenses will not be hired at schools. In addition, committing an employment-related offense (such as stealing from your job) will make it difficult to find employment at many places in the future.

It is now easier than ever for the average person to look up their own criminal history or the criminal history of another person. This is thanks to the vast array of internet resources one can utilize to search criminal record databases.

At Familywatchdog.us, you can perform a free search of sex offenders in the United States. The search results will display on a map, and will include the name of the offender, the offense they were charged with, and a picture of the offender if it is available.

Many states have their arrest record databases online, so you are able to search for criminal offenses for free. If a picture is available, it will be included with the criminal's listing. Not every record is complete.

There are also sites that offer criminal records in exchange for a fee. They will perform a criminal background check for a set rate.

In certain states, you can pay a fee to receive a certified copy of an individual's criminal background from the state's court.

Protect Yourself and Your Family by Performing a Background Criminal Check 10/02/2011

There are many instances wherein dong a background criminal check on a person greatly helped prevents catastrophic events to happen to themselves and to their loved ones. In one case, a father who made a background criminal check on his new neighbor revealed that the person has history of sexual abuse; hence he made sure that his daughters stayed away from that person as much as possible. True enough, the daughter of one of their neighbors was sexually molested and the person was caught. It could have happened to one of his daughters if he did not make such kind of investigation.

In another case, a certain couple was about to hire a new nanny only to find out after doing a background criminal check that the applicant nanny has history of child abuse way back 15 years ago; and she already served her 10-year sentence in jail. Surely, hiring this type of person is placing your child at higher risk; although we can not discriminate them if they have already changed, but the fact that they were capable of doing it has higher chances that they can do it again if certain situations arise.

For this reason, it is always best to protect yourself and your family at all times by performing background criminal check on your new neighbors, office mates, new business partner, applicants for nanny of your children, or job applicants for your business; as well as on people applying as tenant to your house or apartment. Surely, this kind of search will give you more benefits from the minimal investment you made to use this service.

Criminal Background Checks - 5 Reasons Background Checks Can Save You A Lifetime Of Frustration 09/28/2011
0 Comments

Criminal background checks may sound harsh and very serious but the truth is, in today's society hiring the wrong person or bring in the wrong flat mate can have very dire consequences. The fact is, it's a step that could literally save you a lifetime of frustration so don't take it too lightly.

For example, as an employer, simply hiring someone without some sort of criminal public background check is asking for trouble. Remember, you are not offending anyone by doing it because it's done discreetly but if the person you hire is an illegal then you are setting yourself up to fun foul of the authorities.

Background checks can be done free but for better protection, going the paid route makes good sense. We've listed more reasons in this article why they will be good for you and your business.

- Criminal background checks can help you save your company. It is observed that the most common reason for small businesses to fail is ‘fraud’. We trust our employees and sometimes they cheat us. This causes harm to the company and it may face heavy losses. By performing criminal background checks on the employees, we can find out more about the potential employees or even the ones working already.
- Criminal background checks will give your company a more professional look. These checks will make it look more reliable and trustworthy. This will help you in winning your customers and expanding your business.

- Background checks help you in protecting your customers. Every business runs because of its customers. If you have an employee who is a fraud or a criminal, you may loose your valued customers. With such people working for you, the customers will find it difficult to trust the company and will move their business somewhere else.

- They also help in creating a safer environment for the employees. How many times have you heard of people facing non-fatal assaults at their place of work? Many times. With the tolerance level of people going down, violence is constantly on the rise. Thus the criminal background check helps you in avoiding situations like these and creates a safe environment for the people working for you.

- You can keep your companies insurance premiums low by conducting criminal background checks on your employees. For example, if you want to employ a driver, you can check his record for any traffic offence or his license etc. this can help you in making your choice.

What’s Included in an Employee Criminal Background Check?

Every employee background check also includes a thorough employee criminal background check. Some of the information is public and some is private, but all of the information is important in assessing a job applicant. Although the type of information checked varies from state to state and county to county, an employee criminal background check can include:

  • Credit, driving, criminal, education, medical, drug test, court, military, and bankruptcy records
  • Social Security Number
  • Vehicle registration
  • Property ownership
  • Past employment
  • Professional and personal references

All of this information is invaluable, but one aspect that is often overlooked is the credit report. A poor credit rating makes the average applicant a higher risk for identity theft. Additionally, research shows that one in four disputes over information on an employee criminal background check is connected to identity theft issues, so take every precaution to thoroughly evaluate every prospective employee’s credit and criminal records.

Are There Employee Criminal Background Check Laws?

Yes! They vary by state, but the Federal Fair Credit Reporting Act (FCRA) set national standards for performing an employee criminal background check. The law only applies to an employee criminal background check conducted by a consumer reporting agency, which is a firm that administers the employee criminal background check on your behalf. If you decide to perform an employee criminal background check in-house, make sure you follow your state’s background check laws carefully. Remember: Employees have rights, too!

According to the FCRA, some information cannot be reported in an employee criminal background check:

  • Accounts in collection longer than seven years
  • Paid tax liens beyond seven years
  • Bankruptcies after ten years
  • Arrest records, civil suits, and civil judgments after seven years
